Parents of a 3-year-old Win $1 Million After Child Killed By Postal Truck
Record Award For Minor In Tort Claims Act Case
The U.S. Postal Service must pay $1 million to the parents of a 3-year-old Kansas City girl who was killed when a postal truck crashed into the apartment where she was sleeping.
Experts say the judgment, entered by U.S. District Judge. Gary A. Fenner, may be the largest award to date for the death of a minor child in a Federal Tort Claims Act lawsuit.
At the same time, attorneys for the family say restrictions imposed by the FTCA limited the verdict, which would have been much higher had it been possible to try the case under the Missouri wrongful death statute.
